The Americans With Disabilities Act

The Americans with Disability Act (ADA), signed into law in 1990, applies to all colleges and universities receiving any type of federal financial assistance. In effect, it implements section 504 of the Rehabilitation Act of 1973. It provides that:

“No otherwise qualified individual with disabilities in the United States . . .shall, solely by reason of his/her disability, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance.”

In other words, it requires that all colleges and universities receiving federal financial assistance must provide reasonable accommodations for students with disabilities, on a case-by-case basis.
